General terms and conditions
Effective from 23 October 2026. This English text is a translation; in case of any discrepancy the Croatian version prevails.
1. General
These terms govern the relationship between Štajerec global d.o.o., R. F. Mihanovića 9, 10110 Zagreb, Croatia, tax number (OIB) 03035388617 (the Seller) and the buyer (the Buyer) in the sale, delivery and placement of modular and mobile homes (the Homes). They apply to business customers and consumers unless a clause states otherwise. Where a contract differs from these terms, the contract prevails.
2. Website information and offers
Descriptions, photographs, renders and technical data on the website and in the catalogue are for information only and are not a binding offer. Following an inquiry, the Seller prepares a written offer for each project, stating the specification, quantity, price, production and delivery time and payment terms. The offer is valid for the period stated in it.
3. Conclusion of contract
A contract is concluded when both parties sign a written contract, or when the Buyer accepts the offer in writing and pays the first instalment, as agreed. Changes to the specification after conclusion require written agreement by both parties and may affect price and timelines.
4. Prices
Prices are stated in euros in the offer and contract. Unless stated otherwise, the price includes the Home in the agreed specification, transport to the site, crane and placement on prepared foundations. It does not include foundations, utility connections, permits or any work not expressly listed in the offer.
5. Payment
Payment is made in three instalments: 30% – 40% – 30% of the agreed price, according to the schedule set out in the contract, by bank transfer to the Seller's account. In case of late payment the Seller may charge statutory default interest and postpone production or delivery until the amount due is paid.
6. Production and delivery time
Production takes 1 to 9 months depending on quantity and specification; the exact time is stated in the contract and runs from conclusion of the contract and payment of the first instalment, unless agreed otherwise. The Seller is not liable for delays caused by force majeure, weather preventing safe transport or placement, or circumstances on the Buyer's side (e.g. foundations not ready or site not accessible). The Seller informs the Buyer of any delay without undue delay.
7. Buyer's obligations before delivery
- prepare foundations according to the Seller's instructions and the type of ground by the agreed delivery date;
- provide access to the site for a truck and a crane, with enough room for them to operate;
- obtain all permits, approvals and conditions required to place and use the Home at the site. Permits are not part of the Seller's service;
- ensure an authorised person is present on delivery day.
If delivery or placement is not possible for reasons on the Buyer's side, the Buyer bears the additional cost of repeated transport, crane and waiting time.
8. Delivery, placement and handover
The Seller arranges transport of the Home to the site and its placement by crane on the prepared foundations. Placement normally takes one day; the overall timeline depends on the location and the weather. After placement the parties sign a handover record listing any visible defects. The risk of accidental loss or damage passes to the Buyer on handover.
9. Retention of title
The Home remains the property of the Seller until the agreed price has been paid in full.
10. Liability for defects
The Seller is liable for material defects in accordance with the Croatian Civil Obligations Act. Visible defects must be noted in the handover record; hidden defects must be reported in writing without delay once discovered. Any additional manufacturer's or Seller's guarantee applies only if expressly stated in the contract. The Seller is not liable for defects caused by unsuitable foundations, improper use or work by third parties.
11. Withdrawal (consumers)
Homes are made to the Buyer's specifications and requirements. Therefore, under the Croatian Consumer Protection Act, consumers do not have a 14-day right of withdrawal from contracts concluded at a distance or off-premises. All other statutory consumer rights remain unaffected.
12. Termination
If the Buyer withdraws from the contract after production has started, the Seller retains the amounts paid up to the actual costs incurred until termination; further rights of the parties follow the contract and the law.
13. Complaints and disputes
Complaints are submitted in writing to info@stajerec-global.com or by post to the Seller's address, and the Seller replies within 15 days (see Legal notice). The parties will try to settle any dispute amicably. Consumers may also turn to alternative consumer dispute resolution bodies. Croatian law applies. Disputes with business customers fall under the competent court in Zagreb; for consumers jurisdiction is determined by law.
14. Personal data
The Seller processes the Buyer's personal data in accordance with the Privacy policy.
15. Changes
The Seller may change these terms by publishing them on the website. Contracts are governed by the terms in force when they were concluded.
